  • Software and license subscriptions
  • Website builders and no-code/low-code app builders
  • Managed IT and cloud solutions

3. Account Responsibilities

You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your login credentials.
  • Be fully responsible for all activities that occur under your account.
  • Promptly notify GAN Technologies of any unauthorized use or breach of security.

GAN Technologies is not responsible for any loss or damage resulting from your failure to secure your account.

4. Acceptable Use Policy (AUP)

To maintain the integrity, performance, and security of our infrastructure, users must adhere to the following acceptable use guidelines.

You agree NOT to use our services for:

4.1 Illegal Activities

  • Hosting, transmitting, or distributing content that violates any law or regulation.
  • Engaging in fraud, phishing, identity theft, money laundering, or scams.
  • Promoting, facilitating, or instructing others to commit illegal activities.

4.2 Abuse of Network or Server Resources

  • Launching DDoS attacks, port scanning, or attempting unauthorized access to networks or systems.
  • Running malware, viruses, or botnets.
  • Using excessive CPU, RAM, or bandwidth in ways that degrade service performance for other users.
  • Hosting cryptocurrency mining, brute-force bots, or mass mail scripts.

4.3 Spam and Unsolicited Communication

  • Sending bulk, unsolicited emails (SPAM) or SMS messages.
  • Using email lists obtained without proper consent.
  • Operating mailing lists without compliant unsubscribe mechanisms.
  • Sending deceptive, misleading, or fraudulent messages.

4.4 Copyright and Intellectual Property Violations

  • Hosting or sharing pirated software, cracked applications, music, videos, or digital media.
  • Infringing on third-party trademarks, patents, or copyrights.
  • Distributing or linking to warez or illegal download sites.

4.5 Harmful or Offensive Content

  • Posting or distributing material that is obscene, defamatory, threatening, or hateful.
  • Hosting adult content, pornography, or sexually explicit material.
  • Encouraging violence, discrimination, or harm toward individuals or groups.

4.6 Misuse of Licensed Products

  • Reselling or sublicensing software licenses not intended for redistribution.
  • Attempting to reverse-engineer or bypass license verification mechanisms.
  • Sharing API keys, license keys, or account access without authorization.

4.7 Security Violations

  • Testing or scanning network vulnerabilities without written permission.
  • Circumventing authentication, security, or access control mechanisms.
  • Introducing malicious code or exploiting server vulnerabilities.

5. Suspension and Termination

GAN Technologies reserves the right to suspend or terminate any account, without prior notice, if:

  • The user violates these Terms or our Acceptable Use Policy.
  • The account causes harm to our infrastructure, reputation, or other users.
  • The user engages in abusive, fraudulent, or unethical activities.

Suspended accounts may not be reinstated unless the issue is resolved or verified as accidental.
Termination due to policy violation does not qualify for a refund.

6. Data Backup and Responsibility

We maintain automated backups for hosting accounts; however, customers are solely responsible for keeping independent backups of their data.
GAN Technologies shall not be liable for data loss resulting from user actions, system failures, or security breaches.

7. Payment and Renewal

  • All services are billed according to the selected billing cycle.
  • Failure to pay by the due date may result in service suspension or termination.
  • Renewal invoices are issued in advance; continued use implies acceptance of renewal charges.
  • Refunds, if applicable, are governed by our Refund Policy.

8. Limitation of Liability

GAN Technologies is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services.
We do not guarantee uninterrupted or error-free service, though we strive to maintain the highest uptime possible.

9. Indemnification

You agree to indemnify, defend, and hold harmless GAN Technologies, its directors, employees, and affiliates from any claim, loss, damage, or expense arising from your misuse of our services or violation of these terms.

10. Policy Changes

GAN Technologies reserves the right to update these Terms at any time.
Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Kenya.
Any dispute arising under these Terms shall be resolved in the courts of Nairobi, Kenya.
